One benefit of living in Port Townsend, even part-time, is that I find it is a great place to think about my next piece of legal scholarship. This article is one that I started two summers ago. (Or three summers ago if you count the one that is upon us.)  My initial draft ended up being split into two articles, with this one being the first part (even though the other part ended up being published first).

This article covers a lot of legal history with respect to the development of the rules that govern liability for selling unsafe food.  What is in the footnotes is a lot of fun too. But if you want a somewhat easier and less technical read, you can skip the footnotes.  And after you read the article, let me know what you think.
